Is It Constitutional To Make People Pay For Healthcare Under Threat Of Penalty? A VA. Federal Judge Says NO!

District Judge Henry Hudson issued a 42-page ruling that declared the law's individual mandate clause that would require Americans to purchase health insurance or pay a penalty to be unconstitutional.

This issue is headed up all the way to The Supreme Court.

What do you all think? Should we have to pay for health care and if we don't or can't, be penalized for it?

If the Supreme Court takes up the issue, how do you think they will rule?

    We all pay for schools and roads in a form of taxes. I think basic health care services should be treated the same.

    I agree with you Yan, but I think the issue here is
    under threat of penalty.

    I don't think it's constitutional to say if you don't pay for your own or someone elses health care we're gonna fine you, put you in jail or whatever the case may be.

    I think the Supreme Court will rule the same

    I also agree with Yan. They already do the same with car insurance. In most states, if you have a wreck without it you will pay a hefty fine. The thing with health insurance, if everyone pays into the system the cost goes down for everyone.

    I agree with Yan, however I do not agree with the circumstances. I am all for health care reform but the penalizing people if they do not carry it is ridiculous. I think if it would be a better idea to have socialist (*gasp* I said the S word!) AKA universal healthcare instead.

      Oh duh, sorry the actual answer, no, me and my bleeding heart think it is unconstitutional.
